      <title>FOP Releases Score Card System for Members of Congress</title>

        <p>Chuck Canterbury, National President of the Fraternal Order of Police, announced the release of the FOP Scorecard System earlier today to help State and local lodge evaluate their Congressmen and Senators in the upcoming election cycle.</p>
<p>&ldquo;The ability for a member or Lodge to look at the grading system and see where their member &lsquo;grades out&rsquo; will provide them with the necessary information to make an informed decision and will provide Lodge Leadership information to keep their members informed,&rdquo; Canterbury said. &ldquo;It is vital that we stop endorsing candidates that say all the right things but don&rsquo;t do them in Washington. It will be rare for a candidate to always be with us on every issue, but on our list of priorities it is essential that they walk the walk, not just talk the talk.&rdquo;<br />
<br />
Developed as a tool that State and local lodges can use in assessing their Members of Congress for use in the endorsement process, the Scorecard System is meant to be used in conjunction with the Congressional Questionnaires. Each Member is evaluated on their votes and bill cospsonsorships on public safety and labor issues in the 112th Congress.<br />
<br />
The Scorecard System will be available through the Members Only section of the FOP website and will be updated regularly.<br />

            LEOSA Amendments Bill!!! </font></strong></p>
            <p align="left"><font face="Arial, Helvetica, sans-serif"><strong><font size="2"><strong><font color="#000066">Chuck Canterbury, National President of the Fraternal Order of Police, thanked President Barack H. Obama II, who kept his word and signed S. 1132, the &quot;Law Enforcement Officers' Safety Act Improvements Act,&quot; into law this evening. <br />
            <br />
            &quot;Many of our retired officers, who had been facing significant hurdles because some States have failed to implement the law as intended by Congress. will now be able to overcome those obstacles,&quot; Canterbury said.</font></strong></font></strong></font><font color="#000066"><strong><font size="2" face="Arial, Helvetica, sans-serif">&ldquo;</font></strong></font></p>
            <p align="left"><font color="#000066"><strong><font size="2" face="Arial, Helvetica, sans-serif">The legislation, which was crafted by Senator Patrick J. Leahy (D-VT), Chairman of the Committee on the Judiciary and author of the original statute, will improve certain provisions of the Law Enforcement Officers' Safety Act (LEOSA), especially with respect to retired law enforcement officers. Chairman Leahy worked hand-in-hand with the FOP to develop the legislation, which also makes clear that law enforcement officers employed by the Amtrak and Federal Reserve Police Departments, as well as those employed by the executive branch of the Federal Government who are classified as GS-0083s--especially the U.S. Department of Defense--meet the definition of &quot;qualified law enforcement officer&quot; in current law. The new law also lowers the aggregate years of service needed to meet the definition of &quot;qualified retired law enforcement officer&quot; from fifteen (15) to ten (10) and removes confusing language related to that same definition. <br />
            <br />
            &quot;No other law enforcement organizations or police groups took played any role in its successful passage despite intense interest in the bill on the part of active and retired officers,&quot; Canterbury said. &quot;The FOP made this bill a top priority and we got it done.&quot;</font></strong></font></p>

            RE: LEOSA Improvements Act </strong></font></p>
            <p align="left"><font size="2" face="Arial, Helvetica, sans-serif"><strong>The Federal Officers&rsquo; Committee and the National Legislative Office have received several emails, phone calls, and reports with respect to the reaction of the U.S. Department of Defense (DoD) to the enactment of S. 1132 (now Public Law 111-272), the Law Enforcement Officers&rsquo; Safety Act Improvements Act. </strong></font></p>
            <p align="left"><font size="2" face="Arial, Helvetica, sans-serif"><strong>We have shared these reports, and the one official directive we have received to date, with the National Legislative Office. The National Legislative Office is confident that the DoD has misinterpreted the statute and that all Federal law enforcement officers employed by the Department now meet the definition of &ldquo;qualified active or qualified retired law enforcement officer&rdquo; in Federal law. </strong></font></p>
            <p align="left"><font size="2" face="Arial, Helvetica, sans-serif"><strong>However, in an abundance of caution, we are urging our members not to challenge directives, orders, or other instructions with respect to how their employers have interpreted the law. We strongly advise that you not carry under LEOSA at this time&ndash;there is no need for anyone to be a defendant in a test case. </strong></font></p>
            <p align="left"><font size="2" face="Arial, Helvetica, sans-serif"><strong>I know many of you may be frustrated, but please remember that the amendment to LEOSA has been law for less than 72 hours. It will take some time for the changes to be reviewed and understood by all parties&ndash;especially parties hostile to the underlying statute and the FOP&rsquo;s tremendous success in amending the law. Many of us have been waiting for the past six years&ndash;since the passage of the original LEOSA in 2004&ndash;we can wait a few more weeks for the Grand Lodge to get this issue settled. </strong></font></p>
            <p align="left"><font size="2" face="Arial, Helvetica, sans-serif"><strong>To be clear, Congressional intent with the enactment of S. 1132 was to clarify that any Federal law enforcement officer classified as a GS-0083 (or any successor to that series) who is employed by the Executive Branch also be deemed to meet the definitions in 18 USC 926B and 18 USC 926C. On this point, the law reads: ...a law enforcement or police officer of the executive branch of the Federal Government qualifies as an employee of a governmental agency who is authorized by law to engage in or supervise the prevention, detection, investigation, or prosecution of, or the incarceration of any person for, any violation of law, and has statutory powers of arrest. This makes the question of whether or not a Federal law enforcement officer employed by the DoD has statutory arrest powers moot for the purposes of LEOSA, as such officers are now by definition qualified active or retired law enforcement officers. This is the section that the DoD is misinterpreting. </strong></font></p>
            <p align="left"><font size="2" face="Arial, Helvetica, sans-serif"><strong>Congressional intent is made even more plain in Committee Report 111-233, which accompanied S. 1132 when that bill was favorably reported by the Senate Committee on the Judiciary. Section III of that report reads: Section 2(a)(2) makes explicit that active law enforcement officers employed by the Amtrak Police Department, the Federal Reserve, or who serve as law enforcement officers &lsquo;of the executive branch of the Federal Government' are eligible for the law's benefits. </strong></font></p>
            <p align="left"><font size="2" face="Arial, Helvetica, sans-serif"><strong>Finally, the President acknowledged this in his statement which accompanied the announcement that he had signed the bill into law: [S. 1132] ...specifies that current and former law enforcement and police officers of the executive branch of the Federal Government and current and former law enforcement officers of the Amtrak Police Department and the Federal Reserve may generally be exempted from State laws prohibiting the carrying of concealed weapons </strong></font><font size="2" face="Arial, Helvetica, sans-serif"><strong>In our view, the Defense Department is wrong, and National President Canterbury and the National Legislative Office has assured me that they will be challenging their interpretation so that the men and women who the amendment was written to help will be acknowledged as &ldquo;qualified active and retired law enforcement officers&rdquo; and thus able to carry under LEOSA. </strong></font></p>
            <p align="left"><font size="2" face="Arial, Helvetica, sans-serif"><strong>This also underscores the need to adopt H.R. 675, which would amend Federal law to grant law enforcement officers employed by the U.S. Department of Defense the statutory powers of arrest it claims we lack. </strong></font></p>

<p><font face="Arial, Helvetica, sans-serif">IN THE HOUSE OF REPRESENTATIVES </font></p>
<p><font face="Arial, Helvetica, sans-serif">January 26, 2009 </font></p>
<p><font face="Arial, Helvetica, sans-serif">Mr. FILNER (for himself and Mr. MCHUGH) introduced the following bill; which was referred to the Committee on Oversight and Government Reform </font></p>

<p><font face="Arial, Helvetica, sans-serif">A BILL To amend the definition of a law enforcement officer under subchapter III of chapter 83 and chapter 84 of title 5, United States Code, respectively, to ensure the inclusion of certain positions. </font></p>
<p><font face="Arial, Helvetica, sans-serif">Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled, </font></p>
<p><font face="Arial, Helvetica, sans-serif">SECTION 1. SHORT TITLE. </font></p>
<p><font face="Arial, Helvetica, sans-serif">This Act may be cited as the 'Law Enforcement Officers Equity Act'. SEC. 2. AMENDMENTS. </font></p>
<p><font face="Arial, Helvetica, sans-serif">(a) Federal Employees' Retirement System-</font></p>
<p><font face="Arial, Helvetica, sans-serif">(1) IN GENERAL- Paragraph (17) of section 8401 of title 5, United States Code, is amended by striking 'and' at the end of subparagraph (C), and by adding at the end the following: '</font></p>
<p><font face="Arial, Helvetica, sans-serif">(E) an employee (not otherwise covered by this paragraph)-- '</font></p>
<p><font face="Arial, Helvetica, sans-serif">(i) the duties of whose position include the investigation or apprehension of individuals suspected or convicted of offenses against the criminal laws of the United States; and '</font></p>
<p><font face="Arial, Helvetica, sans-serif">(ii) who is authorized to carry a firearm; and '</font></p>
<p><font face="Arial, Helvetica, sans-serif">(F) an employee of the Internal Revenue Service, the duties of whose position are primarily the collection of delinquent taxes and the securing of delinquent returns;'. </font></p>
<p><font face="Arial, Helvetica, sans-serif">(2) CONFORMING AMENDMENT- Section 8401(17)(C) of title 5, United States Code, is amended by striking 'subparagraph (A) and (B)' and inserting 'subparagraphs (A), (B), (E), and (F)'. </font></p>
<p><font face="Arial, Helvetica, sans-serif">(b) Civil Service Retirement System- Paragraph (20) of section 8331 of title 5, United States Code, is amended by inserting after 'position.' (in the matter before subparagraph (A)) the following: 'For the purpose of this paragraph, the employees described in the preceding provision of this paragraph (in the matter before 'including') shall be considered to include an employee, not otherwise covered by this paragraph, who satisfies clauses (i)-(ii) of section 8401(17)(E) and an employee of the Internal Revenue Service the duties of whose position are as described in section 8401(17)(F).'. </font></p>
<p><font face="Arial, Helvetica, sans-serif">(c) Effective Date- Except as provided in section 3, the amendments made by this section shall take effect on the date of the enactment of this Act, and shall apply only in the case of any individual first appointed as a law enforcement officer (within the meaning of those amendments) on or after such date. </font></p>
<p><font face="Arial, Helvetica, sans-serif">SEC. 3. TREATMENT OF SERVICE PERFORMED BY INCUMBENTS. </font></p>
<p><font face="Arial, Helvetica, sans-serif">(a) Law Enforcement Officer and Service Described- </font></p>
<p><font face="Arial, Helvetica, sans-serif">(1) LAW ENFORCEMENT OFFICER- Any reference to a law enforcement officer described in this subsection refers to an individual who satisfies the requirements of section 8331(20) or 8401(17) of title 5, United States Code (relating to the definition of a law enforcement officer) by virtue of the amendments made by section 2. </font></p>
<p><font face="Arial, Helvetica, sans-serif">(2) SERVICE- Any reference to service described in this subsection refers to service performed as a law enforcement officer (as described in this subsection). </font></p>
<p><font face="Arial, Helvetica, sans-serif">(b) Incumbent Defined- For purposes of this section, the term 'incumbent' means an individual who-- </font></p>
<p><font face="Arial, Helvetica, sans-serif">(1) is first appointed as a law enforcement officer (as described in subsection (a)) before the date of the enactment of this Act; and </font></p>
<p><font face="Arial, Helvetica, sans-serif">(2) is serving as such a law enforcement officer on such date. </font></p>
<p><font face="Arial, Helvetica, sans-serif">(c) Treatment of Service Performed by Incumbents- </font></p>
<p><font face="Arial, Helvetica, sans-serif">(1) IN GENERAL- Service described in subsection (a) which is performed by an incumbent on or after the date of the enactment of this Act shall, for all purposes (other than those to which paragraph (2) pertains), be treated as service performed as a law enforcement officer (within the meaning of section 8331(20) or 8401(17) of title 5, United States Code, as appropriate). </font></p>
<p><font face="Arial, Helvetica, sans-serif">(2) RETIREMENT- Service described in subsection (a) which is performed by an incumbent before, on, or after the date of the enactment of this Act shall, for purposes of subchapter III of chapter 83 and chapter 84 of title 5, United States Code, be treated as service performed as a law enforcement officer (within the meaning of such section 8331(20) or 8401(17), as appropriate), but only if an appropriate written election is submitted to the Office of Personnel Management within 5 years after the date of the enactment of this Act or before separation from Government service, whichever is earlier. </font></p>
<p><font face="Arial, Helvetica, sans-serif">(d) Individual Contributions for Prior Service- </font></p>
<p><font face="Arial, Helvetica, sans-serif">(1) IN GENERAL- An individual who makes an election under subsection (c)(2) may, with respect to prior service performed by such individual, contribute to the Civil Service Retirement and Disability Fund the difference between the unrefunded individual contributions made for such service and the individual contributions that should have been made for such service if the amendments made by section 2 had then been in effect. </font></p>
<p><font face="Arial, Helvetica, sans-serif">(2) EFFECT OF NOT CONTRIBUTING- If no part of or less than the full amount required under paragraph (1) is paid, all prior service of the incumbent shall remain fully creditable as law enforcement officer service, but the resulting annuity shall be reduced in a manner similar to that described in section 8334(d)(2) of title 5, United States Code, to the extent necessary to make up the amount unpaid. (3) PRIOR SERVICE DEFINED- For purposes of this section, the term 'prior service' means, with respect to any individual who makes an election under subsection (c)(2), service (described in subsection (a)) performed by such individual before the date as of which appropriate retirement deductions begin to be made in accordance with such election. </font></p>
<p><font face="Arial, Helvetica, sans-serif">(e) Government Contributions for Prior Service- </font></p>
<p><font face="Arial, Helvetica, sans-serif">(1) IN GENERAL- If an incumbent makes an election under subsection (c)(2), the agency in or under which that individual was serving at the time of any prior service (referred to in subsection (d)) shall remit to the Office of Personnel Management, for deposit in the Treasury of the United States to the credit of the Civil Service Retirement and Disability Fund, the amount required under paragraph (2) with respect to such service. </font></p>
<p><font face="Arial, Helvetica, sans-serif">(2) AMOUNT REQUIRED- The amount an agency is required to remit is, with respect to any prior service, the total amount of additional Government contributions to the Civil Service Retirement and Disability Fund (above those actually paid) that would have been required if the amendments made by section 2 had then been in effect. </font></p>
<p><font face="Arial, Helvetica, sans-serif">(3) CONTRIBUTIONS TO BE MADE RATABLY- Government contributions under this subsection on behalf of an incumbent shall be made by the agency ratably (on at least an annual basis) over the 10-year period beginning on the date referred to in subsection (d)(3). </font></p>
<p><font face="Arial, Helvetica, sans-serif">(f) Exemption From Mandatory Separation- Nothing in section 8335(b) or 8425(b) of title 5, United States Code, shall cause the involuntary separation of a law enforcement officer (as described in subsection (a)) before the end of the 3-year period beginning on the date of the enactment of this Act. </font></p>
<p><font face="Arial, Helvetica, sans-serif">(g) Regulations- The Office shall prescribe regulations to carry out this Act, including-- </font></p>
<p><font face="Arial, Helvetica, sans-serif">(1) provisions in accordance with which interest on any amount under subsection (d) or (e) shall be computed, based on section 8334(e) of title 5, United States Code; and </font></p>
<p><font face="Arial, Helvetica, sans-serif">(2) provisions for the application of this section in the case of-- </font></p>
<p><font face="Arial, Helvetica, sans-serif">(A) any individual who-- </font></p>
<p><font face="Arial, Helvetica, sans-serif">(i) satisfies paragraph (1) (but not paragraph (2)) of subsection (b); and </font></p>
<p><font face="Arial, Helvetica, sans-serif">(ii) serves as a law enforcement officer (as described in subsection (a)) after the date of the enactment of this Act; and </font></p>
<p><font face="Arial, Helvetica, sans-serif">(B) any individual entitled to a survivor annuity (based on the service of an incumbent, or of an individual under subparagraph (A), who dies before making an election under subsection (c)(2)), to the extent of any rights that would then be available to the decedent (if still living). </font></p>
<p><font face="Arial, Helvetica, sans-serif">(h) Rule of Construction- Nothing in this section shall be considered to apply in the case of a reemployed annuitant. </font></p>

        <p>To amend title 10, United States Code, to provide police officers, criminal investigators, and game law enforcement officers of the Department of Defense with authority to execute warrants, make arrests, and carry firearms.<br />

Mr. FILNER introduced the following bill; which was referred to the Committee on Armed Services, and in addition to the Committee on the Judiciary, for a period to be subsequently determined by the Speaker, in each case for consideration of such provisions as fall within the jurisdiction of the committee concerned.<br />

A BILL<br />
<br />
To amend title 10, United States Code, to provide police officers, criminal investigators, and game law enforcement officers of the Department of Defense with authority to execute warrants, make arrests, and carry firearms..<br />
<br />
Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled,</p>
<h3>SECTION 1. AUTHORITY FOR POLICE OFFICERS, CRIMINAL INVESTIGATORS,   AND GAME LAW ENFORCEMENT OFFICERS OF THE DEPARTMENT OF DEFENSE TO   EXECUTE WARRANTS, MAKE ARRESTS, AND CARRY FIREARMS.</h3>
<ul>   (a) Authority- Chapter 81 of title 10, United States Code,   is amended by adding at the end the following new section: </ul>
    <h4>`Sec. 1585b. Law enforcement officers of the Department of   Defense: authority to execute warrants, make arrests, and carry firearms</h4>
    <ul>   `(a) Authority- The Secretary of Defense may authorize any   law enforcement officer of the Department of Defense-- </ul>
        <ul>
            <ul>     `(1) to execute and serve any warrant or other process   issued under the authority of the United States;   </ul>
            </ul>
            <ul>
                <ul>     `(2) to make arrests without a warrant--   </ul>
                </ul>
                <ul>
                    <ul>
                        <ul>       `(A) for any offense against the United States   committed in the presence of that officer; and     </ul>
                        </ul>
                    </ul>
                    <ul>
                        <ul>
                            <ul>       `(B) for any felony cognizable under the laws of   the United States if the officer has probable cause to believe that the   person to be arrested has committed or is committing the felony; and     </ul>
                            </ul>
                        </ul>
                        <ul>
                            <ul>     `(3) to carry firearms.   </ul>
                            </ul>
                            <ul>   `(b) Persons To Have Authority- Subsection (a) applies to   any law enforcement officer of the Department of Defense whose duties   include-- </ul>
                                <ul>
                                    <ul>     `(1) enforcing laws enacted for the protection of   persons and property;   </ul>
                                    </ul>
                                    <ul>
                                        <ul>     `(2) preventing breaches of the peace and suppressing   affrays or unlawful assemblies;   </ul>
                                        </ul>
                                        <ul>
                                            <ul>     `(3) conducting, supervising, or coordinating   investigations of criminal activity in programs and operations of the   Department of Defense; or   </ul>
                                            </ul>
                                            <ul>
                                                <ul>     `(4) enforcing any rules or regulations with respect to   Department of Defense property prescribed by duly authorized officials.   </ul>
                                                </ul>
                                                <ul>   `(c) Guidelines on Exercise of Authority- The authority   provided under subsection (a) shall be exercised in accordance with   guidelines issued by the Secretary of Defense and approved by the   Attorney General. </ul>
                                                    <ul>   `(d) Definition of Law Enforcement Officer of the   Department of Defense- In this section, the term `law enforcement   officer of the Department of Defense' means a civilian employee of the   Department of Defense who is any of the following: </ul>
                                                        <ul>
                                                            <ul>     `(1) A Federal police officer or detective as   classified by the Office of Personnel Management Occupational Series   0083 (or any successor to that series).   </ul>
                                                            </ul>
                                                            <ul>
                                                                <ul>     `(2) A game law enforcement officer or special agent as   classified by the Office of Personnel Management Occupational Series   1812 (or any successor to that series).   </ul>
                                                                </ul>
                                                                <ul>
                                                                    <ul>     `(3) A criminal investigator as classified by the   Office of Personnel Management Occupational Series 1811 (or any   successor to that series) and not employed as a special agent of the   Defense Criminal Investigative Service (or any successor to that   service).'.   </ul>
                                                                    </ul>
                                                                    <ul>   (b) Clerical Amendment- The table of sections at the   beginning of such chapter is amended by adding at the end the following   new item: </ul>
                                                                        <ul>
                                                                            <ul>     `1585b. Law enforcement officers of the Department of   Defense: authority to execute warrants, make arrests, and carry   firearms.'.   </ul>
